Pune: National Consumer Disputes Redressal Commission directs Goyal Properties to return money with interest to flat buyers within two months

Pune: The National Consumer Disputes Redressal Commission (NCDRC) directed a developer to refund money taken from flat buyers for not completing construction.

However, the realtor did not comply with the order. The NCDRC took serious note of this and directed the company partners to pay the remaining amount before the next hearing, failing which the company partners should personally appear before it.

A complaint was lodged against Goyal Properties and its partners Subhash Goel, Unmesh Goel and Ramchandra Goel before the NCDRC, New Delhi in 2018 by Abraham Aron, Bracha Aron, Spencer Joseph Gormnalli and Breda Gormanalli. Adv Dnyanraj Sant was the complainants’ legal counsel.

The complainants booked flats in Ganga Sampatti in Wanawadi being built by the company. They paid 95-pc of the amount. The company also registered agreements for the purpose. It was agreed that the complainants would get possession of the flats in December 2011. However, only 80 pc construction was completed within the agreed period.

Since the company could not give possession of the flats as they were not built completely, the complainants approached the NCDRC. Adv Dnyanraj Sant argued before the commission, which accepted their arguments and ruled in their favour.

Goyal Properties returned 50 pc of the amount. But sought extension twice to return the remaining money. Therefore, the lawyer of the complainants again approached the NCDRC to execute the order.

The commission members Justice Sudip Ahluwalia and Rohit Kumar Singh directed that if the company directors, Anuj Goel and Ankit Goel, do not return the remaining amount before the next hearing, they should personally appear before the NCDRC.
