Pune: A couple used to have quarrels because the daughter-in-law and the mother-in-law could not reconcile their differences. Hence, the husband and the wife separated.<\/p>\n\n\n\n
After living in separation for six years, they divorced. It was legalised by the court in the first hearing on November 15. The divorce applications were filed on October 15. Family Court Judge BD Patil gave this ruling.<\/p>\n\n\n\n
According to a Supreme Court decision, the six month\u2019s cooling-off period is exempted if the couple is separated for 18 months. The divorce application can be granted after their mutual consent. In this case, both were living separately for six years. Therefore, the applicant\u2019s lawyer requested an exemption from the six month\u2019s period.<\/p>\n\n\n\n
Adv Rani Kamble-Sonawane, Adv Dnyanada Kadam, Adv Priyanka Wagh and Adv Shital Badade represented the woman while Adv Kapil Dusange argued on behalf of the man. The families applied for divorce with mutual consent.<\/p>\n\n\n\n
Adv Rani Kamble-Sonawane said, \u201cThe couple was living separately for six years after disputes in the family. It was impossible for them to come together again. Since it was a mutual decision, it was not appropriate to wait for six months. The decision saved time. Both are free to live their lives independently.\u201d<\/p>\n\n\n\n
Rakesh and Smita (names changed to protect their identities) got married in a traditional way in April 2016. Rakesh is employed while Smita was a housewife. They have a 7-year-old daughter. Smita and her mother-in-law used to have arguments. After one such verbal fight, Smita left her husband\u2019s house, along with her daughter, in 2018 and went to her parents\u2019 house.<\/p>\n\n\n\n
Therefore, Rakesh filed a divorce application unilaterally in 2019. It was later withdrawn on the condition that he would accept her back in his family. In 2023, she lodged a domestic violence complaint in the court. Later, it was not possible for both to come together. Hence, they applied for divorce with mutual consent and it was granted.<\/p>\n\n\n\n
Their daughter would stay with Smita while Rakesh has to pay her Rs 5 lakh and end their relationship.<\/p>\n","protected":false},"excerpt":{"rendered":"
